The duration of the trademark registration process varies significantly across different intellectual property offices (IPOs) worldwide. Although protection begins from the date of filing a trademark application, it only becomes effective after the IPO examination process is completed.

“Unlocking Global Brand Protection: Navigating Trademark Timelines with Precision and Expertise”

Methodology

To determine the average time required for trademark registration, we analyzed the last 1,000 trademarks registered in eight jurisdictions: the US, Canada, the UK, Benelux, Switzerland, the EU, China, and Australia. We calculated the average duration (in days) for the completion of the trademark application process and compared these results with our findings from August ’21 to assess the general trend in IPO efficiency.

Length of Trademark Registration Process

Among the eight jurisdictions examined, the time required for trademark registration ranged from 75 days (Benelux) to 980 days (Canada). While three countries demonstrated improved efficiency in their IPO examination processes (Benelux, the UK, and the EU), significant slowdowns were observed in China (+97%) and Canada (+68%).

Trademark Registration in Benelux (Netherlands, Belgium, and Luxembourg)

The Benelux IPO is the fastest, with an average registration time of just 75 days and minimal variation (standard deviation of 11 days).

Trademark Registration in the United Kingdom

The UK IPO has shown remarkable improvement, reducing the average registration time from 141 days (August ’21) to 122 days (March ’22), a 13% enhancement. The standard deviation of 46 days indicates that more complex cases may take longer.

Trademark Registration in Switzerland

In Switzerland, the average registration process takes 131 days, with a standard deviation of 40 days. There has been a slight 4% increase in the duration over the past six months.

Trademark Registration in the European Union (27 Member States)

The EU IPO completes the registration process in an average of 135 days, reflecting a 10% improvement in efficiency over the last six months. However, the process duration varies significantly (standard deviation of 70 days).

Trademark Registration in Australia

The Australian IPO has maintained a consistent average registration time of 288 days from August ’21 to March ’22. However, the process shows considerable variation (standard deviation of 249 days).

Trademark Registration in the United States

The USPTO, handling one of the highest volumes of trademark applications globally, takes an average of 419 days to complete the registration process, with a standard deviation of 103 days.

Trademark Registration in China

China has experienced the most substantial decline in IPO efficiency, with the registration process now averaging 571 days, a 97% increase from August ’21. Despite this, the process is relatively consistent (standard deviation of 76 days).

Trademark Registration in Canada

The Canadian IPO takes nearly three years (980 days on average) to complete the registration process, up from 583 days in August ’21, indicating a 68% decline in efficiency.
