What our clients say
United States trademark questions
Do I need a US attorney?
Yes, if you are based outside the United States. The USPTO requires foreign-domiciled applicants to be represented by a US-licensed attorney. Our US partner attorney files for you.
Can I file before I sell in the US?
Yes, on an intent-to-use basis. You must show use before the mark registers, and the USPTO charges a further fee per class at that stage.
Why might the government fee be higher than estimated?
The USPTO adds a further fee per class if the goods description is not taken from its ID Manual, or if the application is incomplete. Government fees are billed at actual cost against the official receipt: if the actual fee is higher than the estimate, the difference is invoiced separately; if lower, it is adjusted. Your attorney uses ID Manual wording wherever possible.
How do I keep the registration?
File a declaration of use between the 5th and 6th year, and renew every 10 years. We remind you before each deadline.
Already registered in the United States?
Official renewal fee: US$650 per class (Sections 8 and 9). When: In the year before the 10th anniversary. A Section 8 declaration of use (US$325 per class) is also due between years 5 and 6. If expired: 6-month grace period, +US$200 per class.
