Deadlines are short and strict. Many offices give one to three months to respond, and some can't be extended. A missed deadline can mean your application is abandoned. Order early and enter the deadline at checkout.
Office actions

When the trademark office objects

Office actions

Reply to an office action

The office has objected to your application, for example because the mark looks descriptive or similar to an earlier one. Your attorney reviews the objection, drafts a reasoned reply with any evidence, and files it before the deadline.

When the office calls a hearing, your attorney prepares written submissions and attends before the officer, in person or online, and reports the outcome to you.

Appeal against a refusal

If the office finally refuses your application, your attorney advises whether an appeal or review is worthwhile and files it. Quoted after reviewing the refusal.

Oppositions

When someone challenges a mark

Oppositions

File an opposition

Spotted a similar mark published in the trademark journal? Your attorney files a notice of opposition with the grounds within the office's opposition window, so it doesn't register.

Oppositions

Reply to an opposition

Someone has opposed your application. Your attorney files the counter-statement (defence) on time, because a missed deadline usually means the application is treated as abandoned.

Send a cease and desist

Someone is using your mark or something confusingly similar. Your attorney sends a formal notice demanding that they stop, setting out your rights and the next steps.

Our feeStart now

Each matter is quoted for one country. Official fees, if any (for example an opposition fee), are confirmed by your attorney and billed at actual cost against the official receipt. We email the quote and a payment link once your attorney confirms it.

FAQ

Office action questions

What is an office action?

It's the trademark office's written objection to your application, also called an examination report. Common reasons are that the mark seems descriptive, or similar to an earlier mark. Most can be answered with a well-argued reply.

Can you reply if another firm filed my application?

Yes. You sign a power of attorney appointing our attorney for this matter, and we take over the file.

How fast can you act on an urgent deadline?

Enter the deadline when you order. If it's within 7 days, your attorney and our team are alerted immediately. Where an office allows extensions, your attorney can request one.

What's the difference between opposing and replying to an opposition?

You file an opposition to stop someone else's mark from registering. You reply to an opposition when someone is trying to stop yours. Both have strict time limits set by the office.

Are official fees included?

No. Some steps, such as filing an opposition, carry an office fee. Your attorney confirms it and you pay it before filing. Replies to office actions usually have no office fee.

What if it goes further, to evidence or a hearing?

Your attorney quotes each later stage before starting it, so you always approve the cost first.
