The IP Australia process

What happens after you file

Typical time: 7–9 months if unopposed. Your attorney handles each stage and keeps you updated.

  1. 1

    Filing

Your attorney files with IP Australia, using the picklist wherever it fits to keep the fee at the lower per-class rate.

  2. 2

    Examination

IP Australia usually examines the application 3 to 4 months after filing.

  3. 3

    Reply, if needed

If the examiner issues an adverse report, a reply can be ordered from us and is quoted on request.

  4. 4

    Acceptance and advertising

The accepted mark is advertised, and others have 2 months to oppose.

  5. 5

    Registration

With no opposition, the mark is registered. The earliest registration date is 7 months after filing.

FAQ

Australia trademark questions

What is the picklist?

IP Australia's list of pre-approved descriptions of goods and services. Using it costs less per class than free-text wording and reduces the chance of objections.

Does an Australian trademark cover New Zealand?

No. New Zealand has its own office, IPONZ, and needs a separate filing or a Madrid designation.

Can I use my mark while the application is pending?

Yes, you can use ™ from filing. You can use ® only once the mark is registered.

Renewal

Already registered in Australia?

Official renewal fee: A$400 per class. When: Up to 12 months before expiry. If expired: 6 months after expiry, +A$100 per month.
